תקנון ותנאי שימוש

1. כללי
ברוכים הבאים לאתר (להלן: "האתר"), המופעל על ידי יוני חולב (להלן: "בעל האתר"). תקנון זה מסדיר את תנאי השימוש באתר וההתקשרות עמנו. הגלישה והשימוש באתר מהווים הסכמה מלאה לתנאים אלה. אם אינך מסכים לתנאי כלשהו, אנא הימנע משימוש באתר.
התקנון מנוסח בלשון זכר מטעמי נוחות בלבד ומופנה לכל המגדרים כאחד.

3. השירותים והתקשרות
האתר מציג מידע על שירותי הצילום שאנו מספקים ומאפשר יצירת קשר לקבלת פרטים והצעת מחיר. האתר אינו מהווה חנות מקוונת ולא מתבצעת בו רכישה או תשלום באופן ישיר.
פנייה דרך האתר אינה מהווה התחייבות מצדנו לספק שירות, ואינה מהווה הזמנה מחייבת. ההתקשרות תיכנס לתוקף רק לאחר תיאום פרטני, מתן הצעת מחיר ואישורה על ידי שני הצדדים. תנאי השירות המלאים (מועדים, היקף, תמורה, מדיניות ביטול ותשלום) יסוכמו במסגרת הצעת המחיר / ההסכם הפרטני שייחתם בין הצדדים, והם הגוברים על האמור באתר.
התמונות, החבילות והמחירים (ככל שמוצגים) הם להמחשה בלבד וניתנים לשינוי ללא הודעה מוקדמת. ייתכנו הבדלים בין תוצרי הצילום בפועל לבין הדוגמאות באתר, בהתאם לתנאי הצילום, ציוד ושיקול דעת אמנותי.
4. קניין רוחני וזכויות יוצרים
כל התכנים באתר — לרבות צילומים, תמונות, טקסטים, עיצוב, לוגו, גרפיקה וקוד — מוגנים בזכויות יוצרים ובדיני קניין רוחני, והם בבעלות בעל האתר או שנעשה בהם שימוש ברישיון, בהתאם לחוק זכות יוצרים, התשס"ח-2007.
אין להעתיק, לשכפל, להפיץ, לפרסם, לשנות, להציג בפומבי או לעשות כל שימוש מסחרי בתכני האתר, כולם או חלקם, ללא קבלת אישור מראש ובכתב מבעל האתר. הזכויות בצילומים נשמרות לצלם גם לאחר אספקתם ללקוח, אלא אם הוסכם אחרת בכתב.
5. תמונות מצולמים וזכויות הדמות
בתמונות המוצגות באתר עשויות להופיע דמויות מזוהות של דוגמנים ומצולמים. כל התמונות מתפרסמות לאחר קבלת הסכמת המצולמים לפרסום תמונותיהם באתר ובערוצים הנלווים. אין לעשות שימוש כלשהו בתמונות אלה (לרבות הורדה, שיתוף או פרסום) ללא אישור בכתב. מצולם המבקש לברר בנוגע לתמונתו או לבקש את הסרתה מוזמן לפנות אלינו בפרטים שבסעיף 2.
6. שימוש מותר באתר
המשתמש מתחייב לעשות שימוש באתר בתום לב ובהתאם לדין, ולהימנע מכל פעולה העלולה לפגוע באתר, בתפקודו, באבטחתו או בזכויות צד שלישי, לרבות הזנת מידע כוזב, ניסיון חדירה, או העלאת תכנים פוגעניים או בלתי חוקיים דרך טפסי האתר.
7. הגבלת אחריות
האתר ותכניו ניתנים כמות שהם ("As Is"). אנו עושים מאמץ לוודא שהמידע באתר מדויק ומעודכן, אך איננו מתחייבים לכך ואיננו אחראים לטעויות, אי-דיוקים או השמטות. השימוש באתר ובמידע שבו הוא על אחריות המשתמש בלבד.
לא נישא באחריות לכל נזק ישיר או עקיף שייגרם כתוצאה מהשימוש באתר, מאי-זמינותו, או מהסתמכות על תכניו. אין באמור בסעיף זה כדי לגרוע מאחריות שאינה ניתנת להגבלה על פי דין.

השימוש באתר ומסירת מידע באמצעותו כפופים גם למדיניות הפרטיות, המהווה חלק בלתי נפרד מתקנון זה.

אנו רשאים לעדכן תקנון זה, וכן לשנות, להוסיף או להסיר תכנים ושירותים באתר, בכל עת וללא הודעה מוקדמת. הנוסח המחייב הוא הנוסח המעודכן המפורסם בעמוד זה.
11. דין וסמכות שיפוט
על תקנון זה ועל השימוש באתר יחולו דיני מדינת ישראל בלבד. סמכות השיפוט הבלעדית בכל מחלוקת הנוגעת לאתר או לתקנון תהא נתונה לבתי המשפט המוסמכים במחוז תל אביב.

Welcome to the website (the "Site"), operated by Yoni Cholev (the "Site owner"). These terms govern the conditions of use of the Site and engagement with us. Browsing and using the Site constitute full acceptance of these terms. If you do not agree to any term, please refrain from using the Site.
These terms are phrased in the masculine form for convenience only and are addressed to all genders alike.

3. Services and engagement
The Site presents information about the photography services we provide and enables contact for details and a quote. The Site is not an online store, and no purchase or payment is made directly through it.
Contacting us through the Site does not constitute a commitment on our part to provide a service, nor a binding order. An engagement takes effect only after individual coordination, a quote, and its approval by both parties. The full terms of service (dates, scope, fees, cancellation and payment policy) will be agreed within the quote / individual agreement signed between the parties, which prevail over anything stated on the Site.
The images, packages and prices (where shown) are for illustration only and are subject to change without prior notice. There may be differences between the actual photographic results and the examples on the Site, depending on shooting conditions, equipment and artistic judgment.
4. Intellectual property and copyright
All content on the Site — including photographs, images, texts, design, logo, graphics and code — is protected by copyright and intellectual property laws, and is owned by the Site owner or used under license, in accordance with the Israeli Copyright Law, 5768-2007.
You may not copy, reproduce, distribute, publish, modify, publicly display or make any commercial use of the Site's content, in whole or in part, without prior written permission from the Site owner. Rights in the photographs remain with the photographer even after delivery to the client, unless agreed otherwise in writing.
5. Subjects' images and likeness rights
The images displayed on the Site may feature identifiable models and photographed individuals. All images are published after obtaining the subjects' consent to publish their images on the Site and related channels. No use whatsoever may be made of these images (including downloading, sharing or publishing) without written permission. A subject wishing to inquire about their image or request its removal is welcome to contact us using the details in section 2.
6. Permitted use
The user undertakes to use the Site in good faith and in accordance with the law, and to refrain from any action that may harm the Site, its operation, its security or third-party rights, including entering false information, attempting intrusion, or uploading offensive or unlawful content through the Site's forms.
7. Limitation of liability
The Site and its content are provided "As Is". We make an effort to ensure the information on the Site is accurate and up to date, but we do not warrant this and are not responsible for errors, inaccuracies or omissions. Use of the Site and the information in it is at the user's sole risk.
We will not be liable for any direct or indirect damage caused as a result of using the Site, its unavailability, or reliance on its content. Nothing in this section derogates from liability that cannot be limited under the law.
8. Third-party links
The Site may include links to external sites or services not under our control. We are not responsible for their content, availability or privacy policies, and the inclusion of a link does not constitute a recommendation.

11. Governing law and jurisdiction
These terms and the use of the Site are governed exclusively by the laws of the State of Israel. Exclusive jurisdiction over any dispute relating to the Site or these terms shall lie with the competent courts in the Tel Aviv district.
